CAPI User Terms of Use Agreement

1. The Canadian Asthma Prevention Institute (CAPI),(the "Provider") and it’s Web Site(s) are accessible worldwide to anyone with Internet access. Access to and use of the Provider and the Site(s) are subject to the terms and conditions of this User Agreement and Copyright Notice and all applicable laws and regulations, including laws and regulations governing copyright and trademark. BY ACCESSING THE PROVIDER AND THE SITE(S), YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS USER AGREEMENT. The Provider and Asthmaworld.org reserve the right to change these terms and conditions at any time. The changes will appear on this screen. By using the Provider and the Site(s), you agree in advance to accept any changes.
2. The materials used and displayed on the Provider and the Sites, including, but not limited to, text, software, photographs, graphics, illustrations and artwork, video, music and sound, and names, logos, trademarks and Provider marks, are the property of the Canadian Asthma Prevention Institute and are protected by copyright, trademark and other laws. Any such content may not be displayed or used for any personal, non-commercial, or commercial use. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material without the written permission of the Canadian Asthma Prevention Institute.
3. The Provider and the Site(s) contain information, facts and opinions from various individuals and organizations. THE PROVIDER AND THE SITES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. CANADIAN ASTHMA PREVENTION INSTITUTE AND ASTHMAWORLD.ORG ARE NOT RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE OR STATEMENT ON THE PROVIDER OR THE SITE(S).
4. Your use of the Provider and the Site(s) is at your own risk. NEITHER THE PROVIDER, NOR ASTHMAWORLD.ORG NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES OR LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE PROVIDER AND THE SITE(S) AND THE INFORMATION AVAILABLE ON THE PROVIDER AND THE SITE(S) OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE PROVIDER AND THE SITE(S). YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST THE PROVIDER, OR ASTHMAWORLD.ORG AND ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF THE PROVIDER AND THE SITE(S) AND THE INFORMATION AVAILABLE THEREON.
5. Any web sites linked to or from the Canadian Asthma Prevention Institute Web site, or products referred to, or Providers listed herein, are not affiliated with the Canadian Asthma Prevention Institute. The products and/or Providers provided by any company or individual which you may access from the Canadian Asthma Prevention Institute Web site are out of the control of Canadian Asthma Prevention Institute. You acknowledge that any reliance upon any advice, opinion, recommendation, statement or other information displayed or distributed through the Canadian Asthma Prevention Institute Web site is at your sole risk.
6. Prior to purchasing any third party products described, or referred to, on the Canadian Asthma Prevention Institute Web site, you are advised to verify pricing, product quality and other information necessary to make an informed purchase. The Canadian Asthma Prevention Institute shall not have any liability arising from your purchases of any third party products based upon the information provided on the Canadian Asthma Prevention Institute Web site. Although the Canadian Asthma Prevention Institute has attempted to provide accurate information to you, the Canadian Asthma Prevention Institute assumes no responsibility for any errors, inaccuracies, omissions, delays or other defects in any of the information provided.
7. This User Agreement and any disputes arising out of or related to the Provider and the Site(s) shall be governed by, and construed and enforced in accordance with, the laws of the Province of British Columbia, Canada.
8. You acknowledge and consent and agree that the Canadian Asthma Prevention Institute may access, preserve and disclose your account information and Materials if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (a) comply with legal process; (b) enforce these Terms of Use, (c) respond to claims that any Materials violate the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of the Canadian Asthma Prevention Institute, its users and the public."
